This is an Application for suspension of substantive sentence.

Heard the learned Advocate for the Applicant and the APP for the State.

Perused the papers on record. The Applicants have been convicted by the leaned Additional Sessions Judge, Hingoli, vide Judgment and Order dated 11.07.2025, for the offence punishable under Sections 353, 332, and 323 read with 34 of the Indian Penal Code, and sentenced as under :
a] For offence punishable under section 353 read with 34 of Indian Penal Code both accused shall suffer R.I. of one year and pay fine of Rs. 5,000/-, in default of payment of fine they shall suffer S.I. of one month.
2 909APPLN3414.2025.odt b] For offence punishable under section 332 read with 34 of Indian Penal Code both accused shall suffer R.I. of one year and pay fine of Rs. 5,000/- in default of payment of fine they shall suffer S.I. of one month.
c] For offence punishable under section 323 read with 34 of Indian Penal Code both accused shall suffer R.I. for three months and pay fine of Rs. 500/- in default of payment of fine they shall suffer S.I. of seven days.

The case of the Prosecution is that, the Applicants created obstructions in the work of Public Servants when they visited the Stone Crusher of the Appellant No. 1, and the Applicants slapped the said officers.

The Applicants/Appellants have paid the fine amount. The term of sentence is one year. The learned Trial Court has suspended the sentence awarded to the Applicants/Appellants till the Appeal period. The Suspension of sentence granted by the learned Trial Court is continued on the same terms till the present Appeal is finally decided. 6.
The Application stands disposed off.
