IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD CIVIL APPLICATION NO. 1594 OF 2022 IN FIRST APPEAL ST. NO. 27520 OF 2019 Usha Gajanan Handewar and others Applicants
Versus
Govind Devrao Patil & another Respondents Mr. K. M. Nagarkar, advocate for the Applicants Mr. M. R. Deshmukh, advocate for Respondent No.2. CORAM : SANDIPKUMAR C. MORE, J.
DATE : 07th July, 2023.
PC :
Heard rival submissions.
Applicants-claimants are seeking condonation of delay of 332 days, which appears to be caused due to their financial crisis.
The learned Counsel for the Insurance Company strongly opposed the application on the ground that there is also circulation delay.
However, considering the statutory right of the
{2} 902-ca1594.22.odt applicants, delay of 332 days stands condoned subject to the condition that the applicants shall not claim any interest for the aforesaid period of delay and also for the delay in circulating the matter belatedly.
The appeal be placed for admission after removal of office objections, if any.
Civil Application is disposed of.
