Heard the learned counsel for the applicants and learned APP for the respondent-State.

The applicants seek bail in Crime No.511 of 2024, registered with Shahada Police Station, District Nandurbar, for the offences punishable under Sections 8(c), 20(b), 20(b)(ii) of N.D.P.S. Act.

It has been alleged against the applicants that they were found selling ganja. Ganja weighing 6 kg and 220 gram was recovered from them. The entire process of recovery of ganja has been done. The purity of ganja would be examined during the trial. Prima facie the quantity recovered from the applicants is below commercial quantity. Hence, there would

944-BA.1696-24.odt be no bar of Section 37 of the NDPS Act while granting bail. The trial may take its time. On certain conditions, the applicants may be granted bail. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant Nos.1. YUVRAJ GINDA PAWAR and

2. FULSING KOCHRYA VALVI be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) each with one solvent surety of like amount each, on the following conditions : (a) The applicants should not tamper with the prosecution witnesses.

(b) They should attend the Police Station as and when called by the Investigating Officer on written notice till filing the charge sheet.

(c) Thereafter, they should attend the trial on each and every effective date.

(d) They should not involve in the identical crime.
