Allegation made against applicant in the FIR is that applicant assaulted informant with iron rod on his calf. 2.

Perusal of investigation papers reveal that in the injury certificate there is no injury suffered by informant on the calf, which is the only role attributed to applicant in FIR. Main overt act is attributed to other accused persons. Similarly situated two of the other accused persons are already released on anticipatory bail by the Sessions Court. In that view of the matter, applicant deserves protection.

In the result, the application is allowed by confirming interim order passed by this Court on 07/10/2022. Till filing of charge-sheet, applicant shall attend concerned police station as and when called by investigating officer.
