This is an Application for Suspension of Substantive Sentence awarded by the learned Additional Sessions Judge-5, Aurangabad, in Sessions Case No. 18 of 2024, convicting the Applicant for the offence punishable under Section 332 of the Indian Penal Code and sentencing to suffer rigorous imprisonment for one year with fine of Rs. 5000/-, in default, to suffer simple imprisonment for 30 days. 2.

The case of the Prosecution is that the Applicant/Appellant had slapped the first informant, who is the Public Servant, on account of blacklisting him. The Applicant/Appellant is the Contractor by profession. He was tried for the offence punishable under Sections 332, 353, 504 and 506 of the IPC.

Heard both the sides.

The Applicant/Appellant has been acquitted of the offences punishable under Sections 353, 504 and 506 of the IPC. Term sentence is awarded by the learned Trial Court. The learned Trial Court has suspended the sentence awarded to the Applicant/Appellant on his furnishing PR and SB of Rs. 25,000/-. The same shall continue during the pendency of the present Appeal.
