PER COURT:

1] The applicants are apprehending arrest in connection with Crime No. 705 of 2021 registered with Newasa Police station, Dist. Ahmednagar for the offences under sections 329, 326, 324, 504, 506, 143, 147, 148, 149 of IPC. 2] The first informant in the FIR dated 16.9.2021 has alleged that the accused had visited his premises and assaulted him and his mother. The applicant Subhash Bansode and Uttam Bansode were armed with knife and iron rod, whereas, Dada and others were armed with stick. They had allegedly assaulted the mother of the complainant. The applicant No. 1 had assaulted complainant by knife on his finger which resulted in amputation of finger as well as lobe on the oral cavity of the complainant, whereas, applicant No.3 Uttam had assaulted with iron rod on the face and back of the complainant.

{2} 927 sr.no..odt 3] When the court showed disinclination to grant relief to applicant Nos.1 and 2 the learned counsel, on instructions, seeks permission to withdraw the application of said applicants.

4] As far as the applicant No.3 is concerned, it is alleged that he alongwith other assaulted Kesarbai on her hand by wooden stick. Injury certificate indicate that there are blunt injuries on the person of Kesarbai. In the light of role attributed to the applicant No.3.

O R D E R

i] ABA No. 1277 of 2021 is partly allowed.

ii] Application at the instance of applicant Nos. 1 and 2 is allowed to be withdrawn.

iii] Application of applicant No.3 is allowed. In the event of his arrest in Crime No. 705 of 2021, registered with Newasa Police Station, the applicant No.3 be released on executing PR bond in the sum of Rs. 20,000/- with one or more sureties in the like amount.

iv] The applicant No.3 shall appear before the I.O. on 2nd, 3rd and 4th December, 2021 between 11.00 a.m. to 1.00 p.m. and thereafter as and when called.

iv] The application stands disposed of.
