By this application a prayer is made to fix the second appeal for final hearing. Prayer clause 'C' seeks direction against the executing Court to decide application below Exhibit-27 in R.D. No. 46/2011. Learned advocate appearing for the applicant submits that he will not press prayer clause 'C' in this application and file separate application with appropriate modified prayers. He further submits that since applicant is senior citizen, the matter may be fixed for final hearing.

Taking into account the submissions advanced and Bhagyawant Punde

The applicant shall be at liberty to file fresh application as regard to prayer clause 'C'.
