ORDER :

The application is filed by wife for transfer of H.M.P. No. A-323/2015, which is presently pending in the Family Court, Aurangabad. Heard both the sides.

It is the contention of the wife that she has no source of income and as she is resident of Parbhani, she will be required to come to Aurangabad to attend the matter and she will be required to spend every time for conveyance and also on one attendant considering her age. It is her case that she has filed two proceedings in Parbhani Court for relief of maintenance and other is filed under Domestic Violence Act. It is her case that in any case, the husband will be required to come to Parbhani to attend those matters and if divorce proceeding filed by the husband is transferred to Parbhani Court, that will not cause any
MCA No. 147/2015 inconvenience to husband.

In view of the aforesaid contentions, this Court holds that application needs to be allowed and some order can be made to take care of the husband also.

In the result, the application is allowed. HMP No. A323/2015, presently pending in the Family Court, Aurangabad is withdrawn from that Court and the same is transferred to the Court of Civil Judge, Senior Division, Parbhani. The new Court is to see that the dates of the present matter matches with the dates in other two cases filed by the wife at Parbhani so that no inconvenience is caused to the husband. The new Court is expected to dispose of the present proceeding within six months from the date of receipt of the record. The parties are to appear in the new Court on 7.4.2016.
