The petitioners are running child care homes having licences under the Juvenile Justice (Care and Protection of Children) Act, 2000 and are now seeking renewal of licences under the successor Act, Juvenile Justice (Care and Protection of Children) Act, 2015.

We have heard both the sides.

A similar issue was considered by us in a group of matters, Mother Teresa Balakashram Vs. The State of Maharshtra and others in Writ Petition No. 7821/2021 and connected matters by our order dated 08.09.2022 to which one of us was a party.

We dispose of the writ petitions by directing the respondents to consider the petitioners' proposals seeking renewal of licences under the Juvenile Justice Act of 2015 on its own merits, by following the course which we have expected of them while deciding the Writ Petition No. 7821/2021 (supra). The decision shall be taken as expeditiously as possible and in any case within sixteen weeks from today.

The petitioners shall appear before the respondent No. 2 - authority on 11.09.2023.
