By this petition, petitioner challenges Judgment and order dated 11th September, 2014 passed by the District Judge, Gangakhed in Misc. Civil Appeal No. 23/2013 thereby confirming the common order dated 24th September, 2013 passed by the 2nd Joint Civil Judge, Junior Division, Gangakhed below Exh. 5 and Exh. 28 in R.C.S. No. 157/2013. Considering the fact that the orders impugned in the present petition are passed in the year 2013 and 2014, no purpose would be served in keeping the petition pending.

Mr L.H.Kawale, learned counsel appearing for the respondent submits that the suit is at the advanced stage of hearing and is likely to be decided shortly.

Considering this position, it would not be appropriate to determine and go into the issue of correctness of the orders passed by the

2 923-WP-3217-2015 trial court and the appellate court at this juncture. The writ petition is accordingly dismissed without expressing any opinion on the merits of the matter. There shall be no order as to costs.
