We have heard Mr. Patil, the learned advocate for the petitioner and Mr. Patnoorkar, the learned advocate for respondent No. 2 and 3. The learned counsel for the petitioner submits that, the petitioner is seeking pensionary benefits and submits that, as per Rule 57 of the M. C. S. (Pension) Rules, his past service shall be counted as half for pensionary purposes. The learned counsel submits that, the petitioner has given representation to the respondent No. 2 in that regard. 2.

In case representation is filed by the petitioner (page 25) and same is pending with the respondent No. 2, then the respondent No. 2 shall take decision upon it on its own merits, expeditiously and preferably within a period of four (04) months

In view of the above, the writ petition is disposed of. No costs.
