1] Learned counsel for the respondent no.3 raises a preliminary objection that the petitioner has a remedy of appeal under Rule 14 of the Maharashtra Zilla Parishad (Discipline and Appeal) Rules, 1964, more particularly Rule 14(1)(b).

2] In the light of that, though learned counsel for the petitioner sought to canvass submissions on merits, we

WP 9364/13 - 2 - are not inclined to consider the same.

3] Writ petition is disposed of with liberty to the petitioner to avail alternative remedy. All contentions of the parties are kept open. Time spent in prosecuting present writ petition be considered by the authority where the appeal would be filed.
