Heard.

The case dates back to 2010. The petitioner had moved for discharge. His application was turned down. Then he approached this Court in revision unsuccessfully. Therefore, his prayer for quashment of criminal proceedings, pending before the Court concerned, cannot be entertained.

The learned counsel for the petitioner then comes around seeking direction to the Trial Court to separate the petitioner's trial from the absconding accused and decide the same within a time frame. A report has been received from the Trial Court. The same indicates accused Nos.1 to 5 and 8 have filed an application for

955 WP.1323.2023.odt separation of their trial (probably under Section 317 of the Code of Criminal Procedure). The learned counsel for the petitioner makes a statement that the present petitioner will also move the similar application. If any other co-accused is absconding, the Trial Court shall separate the trial of the present petitioner and co-accused Nos.1 to 5 and 8 and decide the same within a time frame of eight months from the date of receipt of this order.
