The petitioner is the original plaintiff, instituted the suit for eviction of the tenant mainly on the ground of bonafde requirement. By judgment and decree dated 30.4.2014 the trial court has decreed the suit and directed the defendants to vacate the suit premises and hand over the vacant possession of the premises to the plaintiff within three months. The defendant no.2 alone has preferred the appeal bearing RCA No.92 of 2014 and pending the appeal, the learned Judge of the appellate court has allowed the application Exh.6 and thereby stayed the execution of the decree passed in aforesaid appeal no.345 of 2003 dated 30.4.2014 till the fnal aaa/-

WP 11176.2015.odt decision of the appeal. Learned counsel for the petitioner submits that said appeal fled in the year 2014 is still pending.

In view of the above, by consent, the lower appellate court is hereby directed to dispose off the appeal as expeditiously as possible, however, preferably within a period of SIX MONTHS from the date of this order. Parties shall co-operate the appellate court. With these directions, writ petition is disposed off. No costs. ( V.K. JADHAV, J. ) ...
