IN THE HIGH COURT OF JUDICATURE AT BOMBAY,

BENCH AT AURANGABAD.

APPELLATE SIDE JURISDICTION CRIMINAL APPLICATION NO. 5269 OF 2015 ANIL S/O MANIK AHIRE AND ORS

VERSUS

THE STATE OF MAHARASHTRA AND ANR ...

Advocate for Applicants : Mr. Paresh B. Patil. APP for Respondent No.1 : Mr. K. S. Patil.

Advocate for Respondent No.2 : Mr. L. S. Mahajan. ...

CORAM :

A. V. NIRGUDE & INDIRA K. JAIN, JJ.

DATE :

05th January, 2016.

P.C.:

.

Heard the learned counsel for Applicants.

Perused the application and complaint. We are convinced that Criminal Case No.108 of 2015 is untenable against Petitioner Nos.4 to 10, who are distant relatives of the parties and who admittedly did not reside with Petitioner No.1 and Complainant at the relevant time. Hence, the petition is partly allowed. Criminal Case No.108 of 2015 stands quashed against Petitioner Nos.4 to 10. [ INDIRA K. JAIN, J. ] [ A. V. NIRGUDE, J. ] ndm
