This application is filed by the wife seeking transfer of matrimonial proceeding bearing Marriage Petition No.239/2024, from the Court of learned Civil Judge, Senior Division, Khamgaon Dist. Buldhana to the Court of learned Judge, Family Court at Nanded. 4.

Learned Advocate for the applicant submits that presently the applicant is residing at Nanded with her parents. There is a six years old daughter who stays with the wife. She, therefore, finds it difficult to

( 2 ) travel to attend the Court proceeding at Khamgaon as distance between two places is around 280 k.m. It would be therefore necessary to transfer the proceeding from the learned Court of learned Civil Judge, Senior Division, Khamgaon Dist. Buldhana to the Court of learned Judge, Family Court at Nanded.

Considering above position, this Court is inclined allow the application. Hence, the following order:

ORDER

(i) Misc. Civil Application stands allowed.

(ii) The proceedings of Marriage Petition No.239/2024, from the Court of learned Civil Judge, Senior Division, Khamgaon Dist. Buldhana stands transferred to the Court of learned Judge, Family Court at Nanded. (iii) After transfer of the proceeding, the applicant shall not seek unnecessary adjournments. In case the Trial Court finds that the adjournments are unnecessarily sought, the Trial Court may deal with such application, so as to compensate the respondent-husband, if he personally remains present.

( 3 ) (iv) Whenever request is made by the respondent-husband seeking permission to appear through video conferencing, the same shall be considered liberally by the trial Court.
