Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

It has been alleged against the applicant that he committed murder of his brother. He is languishing behind bar for about 21⁄2 years. The bail is claimed on the ground that he is old aged and suffering from many diseases. However, the trial has begun. One witness is examined.

Learned counsel for the applicant states that in one year only one witness has been examined. Further, the trial remained pending as the witnesses were not served.

Considering the nature of the crime and the protecting the interest of the witnesses from the applicant, the learned trial Court is directed to dispose of the case within a six months from the date of receipt of copy of this order.

The Investigating Officer is directed to remain present on each and every date of the trial to assist the learned A.P.P. and secure the presence of the witnesses well within time.

With the aforesaid directions, the application stands disposed of.
