Heard the learned counsel for the applicants and the learned APP for the respondent-State.

The applicants seek bail in Crime No.307 of 2024 registered with Pundliknagar Police Station, Aurangabad, for the offences punishable under sections 109, 118(1), 352, 351(2), 3(5) of Bhartiya Nvyaya Sanhita, 2023.

It has been alleged against the applicants that they went to the house of the injured. One of the accused had caught hold him and another caused him injury with some sharp weapon and two accused assaulted him with wooden logs. However, the final injury certificate reveals that the injured has suffered simple injuries and he was immediately discharged. Alleged weapons used in the crime have been recovered at the hands of the respective applicants. Material investigation against them appears to have been completed. Therefore, no purpose would be served by keeping them behind bars.

O R D E R
(i) Bail Application is allowed.
(ii) Applicant no.1 Kakarao Shamrao Kakde, applicant no.2 - Nitesh Kakarao Kakde and applicant no.3 Nilesh Kakarao Kakde be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) each with one solvent surety of like amount by each of them, on the following conditions : (a) The applicants should not tamper with the prosecution witnesses.
(b) They should attend the police station if called on written notice by the Investigating Officer till filing of the chargesheet.
(c) They should not enter the place/house of the injured till the trial is concluded.
