Heard learned counsel for the applicant and the learned APP for the respondents-State.

The applicant is apprehending arrest in connection with Crime No. 443/2024 dated 15.8.2024 registered with Nanalpeth Police Station, District Parbhani for the offences punishable under sections 189(2), 191(2), 191(3), 190, 118(1), 115(2), 351(2) and 351(3) of the B.N.S. and under sections 3, 4 and 25 of the Arms Act.

The case against the applicant is that the applicant along with other accused has assaulted the informant and his brother. Thereafter, the applicant and other persons taken the informant towards Gangakhed road and again assaulted with fist and kick blows and by stick. 4.

Today, the learned counsel for the applicant has produced the medical certificate of informant which shows the contusion on back and normal pain killer medicines were prescribed to the informant. The learned counsel for the applicant submits that this Court vide order dated 20.9.2024 has

ABA 1575/24 granted interim relief to the applicant and the applicant has cooperated in investigation as directed by this Court.

Considering that this Court has granted interim relief in favour of the applicant and considering the nature of injuries on the person of the informant, I deem it appropriate to confirm the interim relief. 6.

In view of the above, the application is allowed and the interim protection granted to the applicant on 20.9.2024 is confirmed on the following terms :

i] The applicant shall attend the police station as and when required.

ii] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case. iii] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court.

In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled. 8.

It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.

The application stands disposed of.
