The applicant who is suffering from paralysis is arrayed as accused in the present crime. It is alleged that the applicant brought knife from the house and inflicted its blow on the informant. However, informant avoided the said blow. Both the sons of the applicant are also implicated in the crime alleging assault on their part on the informant. They are arrested and released on bail. Charge sheet is filed in the matter in the month of May-2022 and the case is numbered as RCC No. 81/2022.The wife of the applicant has lodged counter case against the informant's side, which is registered at Crime No. 27/2022 for the offences punishable under section 324, 336, 323, 504, 506 Bhagyawant Punde

{2} 909-ABA-1340-2022 read with 34 of IPC. There is civil dispute going on between the applicant and the informant's side. In that view of the matter, prima facie false implication of the applicant cannot be ruled out. The applicant therefore is entitled for protection. 2.

The application is allowed.

In the event of arrest of the applicant in connection with Crime No. 26/2022, registered with Sonkhed Police Station for the offences punishable under section 307, 326, 504, 506 read with 34 of IPC, he shall be released on executing P.B. and S.B of Rs. 15,000/- with one surety in the like amount. 4.

The applicant to attend the trial and shall not tamper the prosecution evidence.
