The learned advocate for the petitioner submits, on instructions, that the respondent authorities may consider the candidature of the petitioner for promotional avenues, if he is acquitted from criminal trial and is exonerated from the departmental enquiry.

In view of the above, this petition is disposed off. 4.

Needless to state, if the petitioner is granted acquittal and is exonerated from the departmental proceedings, he will naturally have a right to claim his service benefits.
