Heard learned Counsel for the respective parties. 2.

By way of the present petition, the petitioner challenges the order dated 23.11.2022 passed by the Labour Court, First, Aurangabad, in Misc. W.C.A. (DELAY)No.4/2021, whereby the application filed by the petitioner for condonation of delay in Misc. W.C. No.6/2018 came to be rejected.

Learned Counsel for the petitioner submits that the application filed by the petitioner, the petitioner had sufficiently explained the delay caused.

I have considered the reasons mentioned in the said application. It is well settled law that while dealing with an application for condonation

2 919 WP 13699-2023.odt of delay, the Court is required to adopt a liberal approach so as to advance substantial justice. However, the learned Trial Court, while considering the application, has adopted a hyper-technical approach. 5.

In view thereof, I am inclined to interfere with the order under challenge.

Accordingly, the Writ Petition is allowed. The order dated 23.11.2022 passed by the Labour Court First Aurangabad in Misc. W.C.A. (DELAY)No.4/2021 is quashed and set aside.

The delay in filing the application in Misc. W.C. No.6 of 2018 stands condoned.
