Both the learned Advocates appearing for the applicants are submitting that though the statutory period has come to an end, the charge-sheet is not filed and, therefore, they would file an application under Section 167(2) of the Code of Criminal Procedure before the learned Magistrate.

Taking into consideration the statement made by the learned APP that the charge-sheet has not been filed, possibility of application and consideration of the same under Section 167(2) of Code of Criminal Procedure cannot be ruled out and, therefore, present applications are allowed to be withdrawn with liberty to file appropriate application (1)
