The Petitioner's claim towards higher pay scale is pending before the Swami Ramanand Teerth Marathwada University, Nanded. On his claim, seeking an order of pay fixation in the light of the 7th Pay Commission, the University addressed a communication to Respondent No.2 on 10.12.2021, for guidance. A further reminder was sent on 30.12.2022. The Petitioner has himself also addressed Respondent No.2 on 24.01.2023 pleading for an early guidance. By this time, two years have lapsed and Respondent No.2 has not extended any guidance to the University.

In view of the above, we called upon to the learned AGP to make a statement as to the timeline within which such guidance can be granted. He has stated that it could be left to the Court.

Keeping in mind that two years have lapsed in seeking guidance from Respondent No.2 and because of this impediment, the University is unable to decide the claim of the Petitioner, that we direct Respondent No.2 to extend appropriate guidance to the Nanded University within a period of 60 days from today. Once such guidance is received, the Nanded University would proceed to take an appropriate decision on the claim of the Petitioner.

A copy of this order shall be served by the Petitioner upon Respondent No.5 University.
