Learned Advocate for the respondent employee Shri Syed tenders copy of the order dated 7.11.2013 by which respondent No.1 employee has been included in the list of Surplus employees by the Education Department. Said communication is taken on record and marked as Exhibit "X" for identification.

Shri Gunale, learned Advocate appearing on behalf of the petitioner submits that this Court by its order dated 24.7.2016 has disposed off identical matters on the same ground that the employees are included in the list of Surplus Teachers. Copy of the order of this Court dated 24.7.2015 in Writ Petition Nos. 849, 1070 and 1111 of 2013 is taken on record and marked Exhibit "Y" for identification.

Both the learned Advocates jointly submit that this petition can therefore, be disposed of in terms of Exhibits "X" and "Y". 4.
