The petitioners/original plaintiffs are aggrieved by the impugned order dated 03/07/2018, by which, the Trial Court has rejected application Exhibit 18 filed by the plaintiffs seeking appointment of a court commissioner under Order 26 Rule 9 of the Code of Civil Procedure in RCS No. 123/2016.

I have heard the learned Advocate for the petitioners for quite some time.

The Trial Court has rejected Exhibit 18 for the reason that the plaintiffs prayed for the measurement of his own property. When the boundaries are disputed, the properties of the litigating sides should be jointly measured. The suit is now posted for framing of issues.

Notwithstanding the above, a court commissioner can normally to be appointed after the completion of the recording of oral evidence, is the law consistently laid down by this Court in the following matters :- 1.

In view of the above, the impugned order cannot be faulted and this petition is, therefore, dismissed.

It is, however, to be noted that after the recording of oral evidence of the litigating sides, if either of the parties move an
application for seeking appointment of a court commissioner, the Trial Court would consider the said application on its own merits, if a joint measurement is sought and without being influenced by its observations set out in the impugned order.
