Heard the learned counsel for the applicant and learned APP for the respondent-State.

The applicant seeks bail in Crime No.414 of 2024, registered with Parner Police Station, District Ahmednagar, for the offences punishable under Sections 307, 324, 323, 341, 427, 143, 147, 148, 149, 504, 506 of the IPC and Section 3/25 and 4/25 of the Arms Act and Section 135 of the Maharashtra Police Act.

Though the applicant has been named in the FIR he did not capture in the CCTV footage. The CCTV footage is otherwise what has been alleged against him. Such a material discrepancy may help the applicant to claim that he has been

946-BA.1725-24.odt falsely implicated in the crime. No weapon is used by him. Nothing is to be recovered from him. Therefore, his detention would serve no purpose. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant ANKUSH BHAGAJI THUBE be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of like amount, on the following conditions :

(a) The applicant should not tamper with the prosecution witnesses.

(b) He should attend the trial on each and every date.
