The parties to the proceeding had requested to refer the matter for mediation since there was a possibility of an amicable settlement. Accordingly, vide order dated 10.7.2023 Mr. R.D. Sanap, Advocate was appointed as Mediator, the parties were directed to appear before him and he was requested to submit report of mediatoin within a period of 3 months.

In pursuance of the aforesaid order, the parties appeared before the mediator and accordingly, the mediator has submitted his report dated 27th July, 2023 alongwith the terms of settlement which are duly signed by the respective parties and verified by the Section Officer of this court. Same is taken on record and marked as "Exhibit X" for the purpose of identification.

Today, the parties are present alongwith their respective advocates. They have voluntarily signed the compromise terms and accepted the contents thereof. A joint request is made to dispose of the second appeal in terms of the settlement terms. 4.

In view of the above, Second appeal is disposed of. Decree be modified in terms of the terms of compromise dtaed 27.7.2023 placed alongwith report at "Exhibit X". Decree be drawn accordingly. Civil application, if any, stands disposed of.
