This application is fled for anticipatory bail as nonbailable warrant was issued against the present applicant as he failed to appear at the time of committal of the case to the Sessions Court.

Learned counsel for the applicant submits that applicant has already appeared before the Trial Court. He undertakes that he will move appropriate application for cancellation of non-bailable warrant already issued against the applicant.

Having regard to the fact that after completion of investigation charge-sheet was fled and only because the applicant failed to appear before the Judicial Magistrate First Class for the purpose of committal of the case to the Sessions Court, non-bailable warrant came to be issued against him, this is a ft case to protect liberty of applicant.

In these circumstances, there is no impediment in allowing the application. Hence, the application is allowed in terms of the interim order.
