Heard learned counsel for the applicant wife. The respondent husband, despite service of notice of fnal disposal, remained absent.

The applicant wife is claiming transfer of marriage petition No. 83/2021 pending before the learned CJSD Thane, (Link Court, Bhiwandi) to the Court of CJSD, Bhoom District Osmanabad. It is signifcant to note that the applicant wife has also initiated proceedings under section 12 of Protection of Women from Domestic Violence Act bearing Criminal Application No. 19/2020.

Under such circumstances and for the reasons mentioned in the application, it stands allowed in terms of

prayer clause (B) and the Marriage Petition No. 83/2021 fled by respondent husband in CJSD Thane (Link Court, Bhiwandi) is hereby transferred to the Court of learned CJSD, Bhoom District Osmanabad.

The respondent is directed to appear before the Court of CJSD, Bhoom on 3rd November, 2022.

The application is accordingly disposed of.
