The Petitioner is aggrieved by the judgment of the Industrial Court dated 30.04.2013, by which Complaint (ULP) No.42 of 2012, filed by the Petitioner seeking regularization, has been dismissed. Shri Nagarkar, learned Advocate for the Petitioner, submits on instructions that since the Petitioner is in need of work and cannot survive without work, the Respondents may consider his case sympathetically as similarly situated contractual employees are working under the project. The project work continues and is funded by an external agency. The learned AGP submits that if the Petitioner makes a

*2* wp.8870.13.24.01.17 representation, the same would be placed before the concerned Establishment for a decision.

Shri Nagarkar, therefore, submits on instructions that the Petitioner desires to withdraw this petition and make a representation to the Respondents.

Considering the above, this Writ Petition is disposed of as withdrawn, with liberty to the Petitioner to make a representation to the Respondent/ Establishment. It is expected that the representation for performing the same work, as was allotted to the Petitioner earlier, would be considered sympathetically.
