This is an application seeking permission to condone the delay of 514 days caused in filing the present First Appeal. 2.

Perused the application. Heard learned Advocates for both the sides.

Learned Advocate for the appellant pointed out paragraph nos.3 and 4 and stated that due to the critical health condition of the applicant, he was not able to approach the Advocate for filing the appeal in this Court.

Considering the reasons stated in the application and the days of delay, it appears that delay is not deliberately caused. Therefore, the application deserves to be allowed in the interest of justice. Hence, the following order:

Civil Application is allowed.

b.

Delay of 514 days caused in filing the First Appeal is hereby condoned.

c.

Civil Application stands disposed of.

FIRST APPEAL ST. NO.25613 OF 2024 1.

Issue notice to the respondents, returnable on 11.02.2026. 2.

Respondent no.1 is driver of the offending vehicle, hence, it is not necessary to issue notice to him.
