Heard the learned Advocate for the applicant and the learned Advocate for the respondent.

This application is filed for transfer of proceedings bearing H.M.P No. 95/2022 and H.M.P No. 25/2023 pending before the learned Civil Judge, Senior Division, Latur to the Court of learned Family Court at Aurangabad.

The application is vehemently opposed by the learned Advocate for the respondent. It is submitted that the respondent-husband is taking education in post graduation in medical faculty. He is doing post graduation while in service.

It is therefore very difficult for him to travel to Aurangabad. 4.

Considering the above, this Court had specifically called for a report of availability of video conferencing facility at Aurangabad. The report shows that the video conferencing facility is available in the Family Court at Aurangabad. Hence this Court is inclined to allow the application. Hence following order :

ORDER

i.

The Miscellaneous Civil Application is allowed in terms of prayer clause "B".

ii.

Whenever possible, the respondent-husband shall appear through video conferencing.

iii.

The applicant-wife shall not seek any unnecessary adjournments. If the Court finds that unnecessary adjournments are sought by applicant-wife, the Court may pass appropriate order compensating the respondent-husband, if he personally remains present.

iv.

The proceedings be decided as early as possible and preferably within 18 (eighteen) months from the date of such transfer.

v.

The Miscellaneous Civil Application stands disposed off.
