Issue notice to the respondents. Learned A.G.P. waives service of notice on behalf of respondent no.1 and the added party. The learned counsel waives notice for respondent no.2. 3.

It is submitted that the tribe certificate of the petitioner was returned back because the spelling of the tribe was incorrectly mentioned in the tribe certificate. Now a corrected tribe certificate has been received by the petitioner and the same would be submitted within a short time. The learned counsel submits that the petitioner is due to

( 2 ) 925 wp 10880.17 appear for third year B.A.M.S. examination. The result of the B.A.M.S. second year is with held and is not declared. 4.

Consider the above, we pass the following order:

ORDER

i) The petitioner shall submit the tribe certificate before the committee. The committee shall thereafter decide the validation proceedings in respect of the tribe claim of the petitioner expeditiously and preferably within nine months.

ii) In case there is no other impediment, then, the respondent no.2 shall not with hold the result of the petitioner's third year B.A.M.S. examination, so also if the petitioner is otherwise eligible, then, the petitioner may be allowed admission in the fourth year B.A.M.S. course, however, the petitioner cannot be issued any degree certificate or the marks memo of the final year examination without the validation of his tribe claim. iii) Writ petition accordingly disposed of.
