Learned Counsel - Mr. A.B. Kadethankar requested this Court to take appearance of Mr. Dilip S. Mutalik in his place. Accordingly, the appearance of Mr. A.B. Kadethankar stands discharged.

Learned Counsel - Mr. D.S. Mutalik for the appellants placed on record pursis of the present appellants mentioning that, they have settled the matter with legal representatives of respondent No.1 by accepting amount of Rs.3,00,000/- (rupees Three Lacs only) each.

On making enquiry all these appellants submitted before the Court that, in view of the aforesaid settlement they want to withdraw the present Second Appeal by accepting the decision of learned First Appellate Court in R.C.A. No.28 of 2011.

Accordingly, the Second Appeal stands withdrawn and disposed of alongwith pending Civil Application No. 13446 of 2016.
