This application is fled by the wife seeking transfer of H.M.P. No. 52/2017 fled by the respondent - husband for restitution of conjugal rights from Beed to Ahmednagar.

Today, learned Counsel for the petitioner - wife has placed on record the judgment dated 02.01.2020 in H.M.P. No. 457/2018 under which the petition for dissolution of marriage preferred by the wife (H.M.P. No. 457/2018) is allowed by the Civil Judge, Senior Division, Ahmednagar and the marriage between the applicant and non applicant is dissolved.

Copy of the said judgment is taken on record and marked 'X' for identifcation.

Since the marriage is dissolved, it is obvious that till the decree of dissolution is not set aside, the proceedings for institution of conjugal rights fled by the husband have no relevance or signifcance and cannot be proceeded with. 5.

In this view of the matter, the application for transfer is disposed of.
