This application is filed seeking transfer of proceeding of Petition A/1312/2022 pending in the Court of learned Judge, Family Court, Pune to the Court of learned Civil Judge, Senior Division, Bhusawal. It is case of the wife that she resides with her old aged mother. She lost her father long back. There is no one to accompany her to attend the dates at Court at Pune. The distance between Pune and Bhusawal is more than 450 kms. Two proceedings i.e. Cr. Misc. Application No. 399 of 2022 and proceeding under the provisions of Protection Women from Domestic Violence Act bearing PWDVA No. 113 of 2023 are already pending in the Court at Bhusawal. 02.

Considering the above, this Court finds that it would be in the interest of justice to transfer the proceeding from Pune to Bhusawal. Hence, following order :-

( 2 ) mca246.23 i) This Misc. Civil Application is allowed in terms of prayer clause (B).

ii) The applicant-wife shall not seek unnecessary adjournments. If the Trial Court finds that the applicantwife has sought unnecessary adjournments, the Trial Court may impose costs upon the applicant-wife, compensating the husband, if he personally remains present in the Court.

iii) If the respondent-husband makes request for appearing through video conference, same shall be considered by the Trial Court liberally.
