After hearing learned counsel for the parties, it emerges that petitioner's land has been taken in possession for construction of Chambharwadi to Deogaon-Galleborgaon road, however, though earlier on, acquisition proceeding had been initiated but the same had lapsed. It appears that acquisition proceeding would be required to be undertaken afresh, as referred to in the affidavit filed by respondents no. 2 and 3.

In the circumstances, it would be expedient that the concerned would proceed with initiation and completion of acquisition proceeding pursuant to the Right to Fair Compensation

2 WP / 10922 / 2018 and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, including passing of award and payment of compensation by end of September - 2021 or if the parties are amenable for mutual negotiation, it would be open for them to have resort to the same.

Writ petition is disposed of accordingly.
