SEPTEMBER 22, 2025 ORDER :- Mr.L.C.Patil, learned counsel for the applicants - claimants submits that during the pendency of the appeal, original claimants - Kundlik has died on 12.02.2025. He would submit that the present applicant nos.1 to 5 are the legal representatives of the deceased (sole) respondent/original claimant. He would further submit that the right of the original claimant survives in the present applicants and it is needful to add them in the title clause of the appeal as well as application in the capacity of legal representatives of deceased - Kundlik. He would submit that there is delay of 112 days in filing the present application, as the applicants were unaware of the legal proceedings pending; and after getting knowledge of this proceedings they have filed this application. He submits that the delay may be condoned.

In view of the above, the Civil Application is allowed in terms of prayer clauses (A), (B) and (C). Delay caused in filing the application is condoned. The appellant to amend the title clause of the appeal and application therein, by incorporation the names of present applicant nos.1 to 5, as legal representatives of deceased Kundlik.
