The learned advocate Shri Choudhari has graciously caused an appearance on behalf of the Provident Fund authorities and has assisted us. He has drawn our attention to the judgment delivered by this Court at Nagpur in Medineutrina Pvt. Ltd. (Company) through its Director V/s. District Industrial Centre (D.I.C.) and Others; AIR 2021 Bom. 135. 2.

The grievance of the Petitioners is that their P.F. accumulation for the years 2018-2019 till the date of the closure of the sugar factory, have not been disbursed to them. The learned advocate for the P.F. authorities submits that the 7-A enquiry with regard to this period will have to be commenced.

In view of the above, this petition is disposed off with the direction that, on the one hand, the representation of the Petitioners dated 28.08.2023 shall be considered by Respondent No.2 and on the other hand, the PF department is at liberty to initiate 7-A enquiry, expeditiously and follow the procedure laid down in the The Employees Provident Fund and MP Act, 1952 and the Rules / Regulations framed thereunder. The Petitioners may intervene in the said proceedings in order to espouse their cause effectively before Respondent No.2.
