PER COURT :

Shri Chondekar learned Advocate who has caused an appearance on behalf of the respondent husband submits, on instructions, that the respondent has moved the Trial Court for withdrawing HMP No. 52/2018. The Trial Court has not yet permitted him to withdraw the said proceedings since this proceeding is pending before this Court. He submits that if this Court grants a permission, the said proceedings would be withdrawn forthwith.

The learned Advocate for the applicant wife submits that the statement of the respondent may be recorded and an

Considering the above, the respondent is permitted to withdraw HMP No. 52/2018 and the learned Civil Judge Senior Division Ambajogai shall dispose off HMP No. 52/2018 as withdrawn by the husband.

In view of the above, this application would not survive and stands disposed off.

It is made clear that if the husband resiles from the statement recorded as above, the applicant would be at liberty to move a Civil Application for seeking restoration of this proceeding and the same would then be restored alongwith the interim orders.
