We have heard the learned Counsel for the Petitioner and the learned A.G.P. for the Respondents.

We are not considering the Petition on merits; as on merits the remedy would be before the Tribunal. However, the learned Counsel for the Petitioner submits that he is only seeking directions that he has given representation for consideration before the Collector on the ground that the Petitioner is at Serial No.1 of the Wait List and the person who was selected is not

2 wp 12704.2021 eligible as criminal complaint has been filed against him.

As we we are not expected to decide it on merits, the Collector may take decision on the representation (Page No. 8), filed by the Petitioner on it's own merits, preferably within a period of four (04) months.

Writ Petition accordingly stands disposed of. No costs.
