BENCH AT AURANGABAD 910 WRIT PETITION NO.10476 OF 2022 PARAM SANJAY DODAL

VERSUS

THE STATE OF MAHARASHTRA THROUGH SECRETARY AND ANOTHER ...

Advocate for Petitioner : Mr. S. P. Brahme AGP for Respondents: Smt. R. P. Gour Advocate for Respondent No.2 : Mr. M. D. Narwadkar ....

CORAM : RAVINDRA V. GHUGE & SANJAY A. DESHMUKH, J.

DATE : 11.10.2022 PER COURT :- 1.

The petitioner is before the Court with two score cards of his State Common Entrance Test, conducted by the State CET cell Mumbai. The petitioner has scored 79.83% marks in his 12th standard examination. On 15.09.2022, when his CET result was declared online, he checked his score at 4:46.15 p.m. and he was shown to have achieved a total percentile Score - PCM as 99.82748959. On 27.09.2022, he required the result for making an application to a particular course. The print out of the score card of MHT CET-2022, at 1:14:45 p.m., indicated his total percentile Score- PCM as 92.9340806.

2.

With the assistance of the learned Advocate for the petitioner and the learned Advocate representing the State CET cell, we have considered the record. It is impressed upon us that the score card having the exact address of the State CET cell, the correct role number and application number and water mark in the center of the score card, is the authentic website indicating an authentic result. The petitioner is said to have scored 92.9340806 percentile.

3.

The learned Advocate representing the State CET cell submits that a decision will be taken that whenever such two types of score cards are noticed in relation to a single candidate and if it is found that one of the score card is on a vexatious website, the cell would immediately refer the case to the Cyber Crime Cell. Even in present case and few more cases, the State CET cell would approach the Cyber Crime Cell.

4.

In view of the above, the learned Advocate for the petitioner submits on instructions obtained after a pass over that the petitioner desires to withdraw this petition and would rely on the score 92.93..... In the event, the Cyber Crime Cell notices that the petitioner score of 99.82... is the correct score,

the petitioner would avail the remedy as may be permissible. 5.

In view of the above, this petition is disposed of as withdrawn with liberty.
