1) Heard respective Counsel appearing for the parties.

2) This is an application seeking withdrawal of amount deposited by the Insurance Company in pursuance to the award passed by the Motor Accident Claims Tribunal, Latur on 19.11.2013 in M.A.C. Case No.326/2009.

3) The claimants/Respondents No.1 to 3 shall be permitted to withdraw 75% of the amount falling to their share deposited by the Insurance Company in this Court on tendering an undertaking that, in the event of success of the appeal they would re-deposit the amount withdrawn by them within a period of 12 weeks from such decision.

4) The balance amount shall be invested in fixed deposit, initially for a period of 3 years and the fixed deposit receipt shall be renewed thereafter for a period until disposal of the appeal.

5) Civil Application shall disposed of.
