The petitioner takes an exception to the order dated 13.07.2023 passed by the Respondent No.2/ Caste Scrutiny Committee thereby invalidating the caste claim of the petitioner of belonging to Pangul Nomadic Tribe (B).

The learned Advocate for the petitioner submits that after passing of impugned order by the Respondent No.2/ Caste Scrutiny Committee , the petitioner could trace out the caste validity certificate of her cousin-uncle viz. Sunil Dhondu Hingmire and therefore, seeks remand of the matter back to the Respondent No.2/Caste Scrutiny Committee for fresh consideration. The learned Advocate for the petitioner further submits that caste validity certificate of her cousinuncle dated 23.02.2012 could not be placed before the Respondent No.2/ Caste Scrutiny Committee for its consideration.

Though learned A.G.P opposes the said request, however, considering the fact that admittedly the caste validity certificate sought to be placed on record is traced out by the petitioner after passing of impugned order, we deem it appropriate to remand the matter back to the Caste Scrutiny Committee to give sufficient opportunity to the petitioner to substantiate her claim. Hence, we pass the following order :

ORDER

A) Writ Petition is allowed partly.

B) The impugned order dated 13.07.2023 passed by the Respondent No.2/ Scrutiny Committee is set-aside. C) The Respondent No.2/Scrutiny Committee shall decide the caste claim of the petitioner afresh by giving proper opportunity of hearing to the petitioner. D) The Respondent No.2/ Caste Scrutiny Committee shall make an endeavour to decide the Caste Claim of the Petitioner within a period of three months from today. ( ABASAHEB D. SHINDE, J. ) ( R.G.
