ORDER

(10th May, 2025) 1.

Parties have arrived at terms of compromise. Terms are duly singed by the claimants and Insurance Company. Claimants are present before the panel. Terms of compromise are voluntary. 2.

This panel is informed that the Tribunal has committed error for considering the income of deceased who is bachelor to the extent of 100% instead of 50% as per the settled position of law. In view of this, settlement arrived at between the parties for accepting the compensation of Rs. 19,00,000/-is reasonable hence accepted. The amount of compensation of Rs. 19,00,000/- be distributed between the claimants in equal proportion. FA-2425-2023.odt

The panel is also informed that except for claim Tushar (minor) other claimants are major. Hence, the said major claimants are permitted to withdraw the amount in equal proportion without reference to the Court. The amount to the share of minor claimant be kept in Fixed Deposit in any nationalized bank upto he attaining the age of majority. 4.

In view of this, appeal stand disposed of.

The Court Fee Refund Certificate be issued as per the rules. 6.

The Civil Application(s), if any, stand disposed of. 7.

The award/decree be drawn up in terms of compromise. 8.

No order as to costs.
