IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 907 WRIT PETITION NO.11432 OF 2025 Kachru Babulal More

VERSUS

The State of Maharashtra Through Its Revenue Secretary and Others ...

Mr. Vilas B. Giri, Advocate for the Petitioner. Mr. S. B. Narwade, AGP for Respondents/State. ...

CORAM : SMT. VIBHA KANKANWADI & HITEN S. VENEGAVKAR, JJ.

DATE : 14 NOVEMBER 2025 ORDER :

.

Present petition has been filed challenging the orders dated 17.11.2013 and 06.11.2023 passed by respondent No.4, further for directions to respondent No.4 to verify and decide the application under Section 38-E and F of the Hyderabad Tenancy and Agriculture Land Act, 1950 dated 05.02.2024 and the consequential reliefs. 2.

Heard learned Advocate for the petitioner. Learned AGP waives notice for respondent Nos.1 to 4.State. There is no necessity to issue notice to the other respondents.

3.

The first and the foremost fact that is required to be mentioned here [1]

907-wp-11432-2025.odt that the petitioner is challenging the order dated 17.11.2013 in 2025 and the delay appears to have not been satisfactorily explained for that, however, according to the petitioner, same order has been passed on 06.11.2023 by respondent No.4 and thereafter the application under Section 38E and F of the Hyderabad Tenancy and Agriculture Land Act, 1950 has been filed by the petitioner before respondent No.4 on 05.02.2024. Respondent No.4 would be Agricultural Lands Tribunal under the said Act and it also appears that on 28.06.2024 notice was also given by respondent No.4 for taking up the matter. Under such circumstance, we are entertaining the writ petition to the limited extent i.e. for prayer clause 'B'.

4.

Learned AGP submits that the said petition can be decided within a period of six months from today.

5.

We take the said statement as undertaking and dispose of this writ petition with directions to respondent No.4 to decide the application dated 05.02.2024 under Section 38-E and F of the Hyderabad Tenancy and Agriculture Lands Act, 1950, within a period of six months from today.
