2] Leave granted. The Petition is disposed of as withdrawn, with liberty as prayed for.

3] However, we make it clear that, we have not expressed any opinion about

4] Needless to observe that, the petitioner has spent sometime in prosecuting this matter, and in case there is delay in filing the Original Application, the Maharashtra Administrative Tribunal to consider the time spent by the petitioner in prosecuting the present Petition.
