1] There is consensus amongst the learned counsel appearing for the respective parties that, the purpose of filing this PIL has been served, and the same can be conveniently disposed of. 2] In the light of submissions made across the bar, PIL No.89/2015 stands disposed of. However, we make it clear that as and when it would be required or necessary during the course of hearing of the PIL No.38/2017 [Vikas Prakash Yedake Vs. The State of Maharashtra & others], we may refer to pleadings, averments and replies filed by the respective respondents in disposed of PIL No.89/2015.
3] In view of disposal of PIL No.89/2015, Civil Application Nos.1652/2016, 11869/2016, 16155/2016, 3341/2017, 4894/2017 & 4892/2017 do not survive, and the same also stand disposed of. 4] Learned counsel appearing for the petitioner on instructions of the petitioner submits that, the petitioner has deposited Rs.1,00,000/- [Rs.One lac] in this registry, and out of the said amount, 50% amount be given to the Government Child Care / Shelter Home, Government of Maharashtra, Paithan, Tahsil Paithan, District Aurangabad, and remaining 50% amount be refunded to the petitioner.
Since the petitioner himself has volunteered to give 50% amount in favour of the Government Child Care / Shelter Home, Government of Maharashtra, Paithan, Tahsil Paithan, District Aurangabad for the welfare of the girls staying there, we have no hesitation to direct the registry to divert / give 50% amount in favour of the Government Child Care / Shelter Home, Government of Maharashtra, Paithan, Tahsil Paithan, District Aurangabad and remaining 50% amount be refunded to the petitioner.
