Mr. Irpatgire, learned counsel submits that one of the apprehension of the petitioner of including the Managing Director, in the tender process of giving the respondent - Sugar Factory on lease basis, is accepted by the State in view of para 8 of affidavit in reply. The learned counsel submits that the respondent No. 5 should credit the lease amount to the petitioner bank.

Mr. Thoke learned counsel for respondent No. 5 submits that whatever rent amount would be received, would be credited to 1/2

96.wp.10658.18.odt the petitioner. Para 8 of the affidavit filed by the State reads thus : "8. I say and submit that, the petitioner bank submitted a letter dtd. 8.8.2018 and requested to include Managing Director of petitioner bank in the tender process of giving respondent no. 5 sugar factory on lease basis. After this communication by managing director of petitioner bank, respondent no.2 commissioner of sugar communicated to respondent No. 3 that petitioner bank should be included in the process of lease agreement and make Tri-party lease agreement."

The learned counsel submits that in view of the aforesaid, the apprehension of the petitioner is taken care of. 4.

In light of that writ petition is disposed of. Civil Application is also stands disposed of. The parties can proceed further in accordance with law.
